    The Green Industry Act (Loi Industrie Verte) is France’s core green transformation policy that officially came into effect in October 2023. This policy focuses on promoting the industrialization of domestic green industries in France, attracting and supporting domestic green industries and investments through subsidy policies, and benchmarking against and responding to the Inflation Reduction Act (IRA) of the United States.

  • · Industrial land guarantee: Support the clearance of 50 old factory areas and invest 1 billion euros to provide industrial land for green projects; Simplify and expedite the approval procedures for factory construction.

  • · Green Public procurement: Revise the Public Procurement Law to give priority to purchasing products that meet environmental protection standards (such as using recycled materials and low-carbon processes).

  • · Develop green labels: Develop the “Triple  E” environmental protection enterprise label and standard, and recognize and reward green pioneer enterprises.

  • · Electric vehicle subsidy reform: Ecological bonuses (5,000-7,000 euros) are linked to carbon emissions throughout the vehicle’s entire life cycle.

The challenges and pressures faced by Chinese enterprises under the background of the Green Industry Act

  • The carbon footprint requirement constitutes an invisible barrier

    Starting from January 2024, France will directly link the “eco-bonus” for electric vehicles to the production carbon footprint, requiring the use of low-carbon energy in the vehicle manufacturing process and the calculation of emissions throughout the entire life cycle. Electric vehicles made in China are prone to losing their subsidy eligibility due to the high proportion of coal-fired power (about 60%) and carbon emissions from long-distance transportation, which has undermined their competitiveness.

  • Industrial subsidies weaken the cost advantage

    The bill attracts the transfer of battery and photovoltaic industry chains with high tax credits. The localization production orientation weakens the cost advantage of Chinese enterprises.

  • The green label certification is highly professional

    The upcoming “Triple E” corporate environmental label will become a threshold for public procurement in France in the future, setting high requirements for corporate environmental transparency, life cycle data disclosure, energy efficiency and carbon performance, etc. It is difficult for enterprises to independently complete data preparation, document organization and label application.
